Who can stay in the UK after Brexit?

Depending on how long you've lived in the UK and whether you've previously applied to live there, your EU Settlement Scheme application may differ.

If you haven't been a UK resident for more than five years: For pre-settled status, you must submit an application to the EU Settlement Scheme. For pre-settled status, you must demonstrate that you have resided in the UK for at least one day, during which time both of the following occurred:

• prior to or on December 31, 2020
• In the six months prior to submitting your application

With pre-settled status, you can stay in the UK for up to five years. If you want to stay for longer, you can then apply for established status.

If you have resided in the UK for at least five years, you should apply for established status under the EU Settlement Scheme. The following things are possible once you have settled status:

• Residing and working in the UK indefinitely
• Maintain established status while living abroad for up to five years.
• Request that your family joins you in the UK.
• After one year of settled status, or right away if you're married to a British citizen, submit an application for citizenship.
